Overview

This documentation provides an in-depth walkthrough of the eligibility criteria for procuring insurance coverage as defined by the 1099Policy API. It covers various aspects of eligibility, including state-specific requirements, insurance application manual review, assignment eligibility, and certificate eligibility.

Eligibility by State

Workers Compensation

In certain states, workers' compensation insurance can only be purchased through a government-operated insurance company. These states are often referred to as monopolistic states and contractors doing work in these states are required to purchase insurance directly through the state. The list of monopolistic states include: North Dakota, Ohio, Washington, and Wyoming.

The API returns a descriptive 400 bad request error response when you make a POST quote request for a contracting doing work in a monopolistic state, but to make the process as seamless as possible for contractors in these states, we recommend directing them to the appropriate website to procure coverage.

Decoupling workers comp coverage

The monopolistic state limitation is specific to workers compensation coverage. If the contractor wants both workers compensation and general liability we recommend decoupling the two so that the contractor can move forward with procuring general liability exclusively.

General Liability

We offer general liability insurance for residents of all states except Hawaii (HI). If you make a POST quote request for a contractor that resides in HI and is seeking general liability coverage, you'll see a 400 error code response and a descriptive message returned by the 1099Policy API.

Decoupling general liability coverage

The Hawaii residency limitation is specific to contractors procuring general liability coverage. If the contractor is seeking both workers compensation and general liability we recommend decoupling the two so that the contractor can move forward with procuring workers compensation exclusively.

Other coverage types

By default, once you've been onboarded onto the 1099Policy platform, the contractors on your platform will immediately have access to general liability (general) and workers compensation (workers-comp) insurance coverage. If you send a POST quote request and the coverage type is not one of these two, you'll see a 400 error code response.

Professional liability and cyber

We're currently piloting professional and cyber coverage types. If you're interested in participating in the pilot contact your customer success rep at support@1099policy.com.

International Coverage

We don't currently offer coverage to contractors that both reside and work outside of the US, so if you make a POST quote request for a contractor that fits that criteria you'll see a 400 error code response. In an effort to support our gloabal clients, we continue to expand our footprint – contact us at info@1099policy.com if you're interested in helping your contractors outside of the US procure coverage.

Contractors doing work abroad

This international coverage limitation doesn't necessarily apply to contractors residing abroad and doing work in the United States or contractors residing in the United States and doing work abroad. Contact your customer success rep at support@1099policy.com to learn more about edge cases we currently support.

Coverage Dates

If you attempt to send a POST quote or assignment request for a work assignment with an effective date that's set in the past, we'll return a 400 error code response. We'll also return a 400 error code response if the work assignment end date is more than one year after the effective date. If you have a contractor on your platform that is currently working on an assignment but still needs coverage, we recommend using the API to update the coverage date range to include the remaining days left on the work assignment.

Application Manual Review

Once the contractor opts-in to procure insurance, you'll generate a link to an insurance application that the contractor completes. As part of the application process the contractor confirms the information that we have on file and answers questions. Although the application typically takes only minutes to complete, in some instances the application requires manual review by the 1099Policy team.

We review every application that's flagged for manual review within 24 hours. Reach out to support@1099policy.com if you have an application in manual review for more than 24 hours.

Office of Foreign Assets Control (OFAC)

We run every contractor name against a list of names on the OFAC sanctions list. In rare cases, the OFAC check results in a false positive match which requires that the 1099Policy team manually review the contractor's application details. As part of your integration with the 1099Policy API, we recommend registering your webhook endpoint to receive events including the application.manual_review event so you can update the contractor messaging on your platform as needed when contractor insurance applications are moved to manual review.

Losses Within Last 3 Years

Applications may undergo manual review if the contractor has had insurance claims or losses within the last three years. This review ensures that the contractor meets all eligibility and risk criteria set by our carrier partners. As with the OFAC manual review, we'll publish the application.manual_review event so you track the contractor's application status in real-time.

Assignment Eligibility

Contractors that complete an insurance application are automatically covered for subsequent work assignments provided that they meet the criteria detailed in the Managing repeat coverage guide. Every time we're notified of an assignment via a POST assignment request, we'll notify the contractor and, if eligible, we'll charge their credit card on file 24 hours after we send notification of the upcoming charge, provided their credit card is still valid.

Valid Credit Card on File

If we're unable to charge the contractor's credit card for any reason, we'll publish a policy.cancelled event and notify the contractor to let them know that the current assignment and any future assignments are ineligible for coverage until the credit card on file is updated.

Withholding premium

Organizations that opt into withholding and remitting premium on behalf of the freelance contractor sidestep issues that arise due to failed credit card charges. Contact your customer success rep to learn how the you can increase conversion by remitting premium on behalf of contractors using your platform.
